Bryan, Kain - Solicitors is generally recognised as one of Sydney's leading small Family Law firms. The firm is based in a small mid Sydney office, although proceedings in the Melbourne Family Court and relating to properties in other states and other countries are often also dealt with.
In 1999 the firm was proud to be one of the first to attain the Towards Best Practice@ accreditation, the standard then set for legal firms in Australia. We were pleased to have our accolade acknowledged by our picture on the cover of the Lawyers' Journal in New South Wales.
During 2000 we made substantial alterations to the firm, not least of which was greatly reducing the number of staff. This appears to have achieved the necessary goals, including attainment of a higher level of quality of service, and we aim to continue to enhance the uninterrupted improvements which are taking place within the firm. We strive towards close communications and close and personal service, and above all towards outcomes which are satisfactory in the long term, not just the short term.
Marriage and de facto relationship breakdown brings many problems and stresses. Many of those can be minimised by the early adoption of strategies which will dilute tensions and assist to position the parties where they can early and relatively easily and amicably agree on a property settlement, and effect that settlement quickly and with little trauma. Early advice on those possibilities is the firm's speciality, as is speedy and cordial negotiation of final arrangements, and all necessary steps to effect such arrangements.
Both partners in the firm are held in high repute. The firm's founding partner, Kerry Ridley Bryan, no longer spends substantial time at the firm but is available as needed. A piece of litigation so intimately connected that it bears his name - Bryan's case - is still seen as one of the simplest yet most financially meaningful of developments in law relating to stamp duty which is otherwise payable. The law arising from Bryan's case has been embodied in legislation and continues to be of great financial relief to many thousands of people each year who transfer property between entities and former partners as a result of the end of a relationship. As a direct consequence of Bryan's case such persons can undertake the transfer without having to pay otherwise necessary substantial stamp duty.
Wendy Bernardette Kain is now the firm's Family Law partner, having begun to work in that Court in 1986. She continues litigation there where necessary, but most frequently continues to negotiate settlements on most property divisions after marriage or relationship end, to the extent that her average attainment of settlements of client matters without substantive litigation is now in excess of 96% of all.
